Legal aid
We will advise you upon the availability of public funding where appropriate. There are two tests for eligibility, firstly an “Interests of Justice Test” and secondly, a financial eligibility test.

In the Magistrates Court:
It is an “in” or “out” test of financial eligibility.

  • You do not have to pay if you are under 18.
  • You do not have to pay if you are on specific benefits – Income Support, Income-based JSA, Guaranteed State Pension Credit, Income–related employment and support allowance.
  • If your annual household income minus living costs and family circumstances is £12,475 or less you will get legal aid.
  • If the figure is £22,325 or more you will not be eligible for legal aid.
  • If your assessed annual disposable income is £3,398 or less you will be entitled, if more you will not.

In the Crown Court:

  • You do not have to pay if you are under 18.
  • If you are on specific benefits.
  • Your household’s income after you have paid your main bills is £3,398 or less per year (£283.17 or less per month) and you have less than £30,000 in capital.

If you fall outside these criteria then you will have to pay a contribution to your legal aid costs. If you are found not guilty your money will be refunded with interest.

More information will be supplied to you in our initial letter of appointment and we will advise you in detail about the likely costs at the start of your case.

We will also advise you of the costs of your case in advance if you are to pay privately.
